TOGGL3 TV — Tournament Host Terms

These Tournament Host Terms (“Host Terms”) apply when you host a community tournament on TOGGL3 TV. They are an addendum to, and are incorporated by reference into, the TOGGL3 TV Terms of Service (the “Terms”), as described in Section 13.2 of the Terms. The Community Guidelines and the Privacy Policy also apply. Capitalized terms not defined here have the meaning given in the Terms. Where these Host Terms conflict with the Terms about hosting a community tournament, these Host Terms control to the extent of the conflict.

About these terms

Definitions. In these Host Terms:

How you accept. Before your first community tournament you confirm each of the eight points summarized at the start of Sections 1 to 8 and accept these Host Terms. We record the version you accepted and when. Each time you publish a tournament, you also confirm three things for that tournament: that you are not competing in it, that no money for it passes through TOGGL3, and that player feeds will be used only in your broadcast. We record those confirmations with the tournament.

1. Money

In short: TOGGL3 doesn’t handle any money for your tournament. We don’t collect, hold, refund or pay out entry fees, prizes, prize pools or bounties, and we don’t verify or guarantee anything you promise. If you arrange any of these, you do it yourself, outside TOGGL3, and you alone are responsible for it, including refunds, delivery and disputes.

1.1 Tools only

TOGGL3 provides tournament tools: registration, brackets, results, private player feeds and the Control Room. A community tournament has no entry-fee, prize, prize-pool or bounty feature. TOGGL3 does not collect, hold, escrow, refund, award, pay out or display any entry fee, prize, prize pool or bounty for a community tournament, and it does not verify, endorse or guarantee any promise you make about one.

1.2 Your arrangements are yours alone

Any entry fee, prize, prize pool, bounty or other arrangement connected with your tournament is made by you, outside TOGGL3, and is solely between you and the people involved. TOGGL3 is not a party to it. You alone are responsible for it, including collecting and safeguarding any money, refunds, delivering prizes, and resolving disputes about it. You may not state or suggest that TOGGL3 sponsors, holds, backs or guarantees any arrangement you make.

1.3 No payment through TOGGL3 features

You may not require or request a tip, gift, channel subscription or any other purchase on TOGGL3 as an entry fee, as a condition of taking part, or as a contribution to a prize.

2. Law & tax

In short: You’re responsible for following the law where you and your players are. That includes rules on contests, sweepstakes, prize promotions, gambling and tax. No betting or wagering on match outcomes through TOGGL3 — chat, polls, predictions or channel points included.

2.1 Legal compliance

You are responsible for complying with every law that applies to your tournament where you and your players are located, including laws on contests, sweepstakes, prize promotions, lotteries, gambling, consumer protection, advertising and tax, and any registration, bonding, disclosure or tax-reporting duty those laws impose on you. Nothing TOGGL3 provides is legal, tax or financial advice.

2.2 No betting or wagering

You may not run, promote or allow betting or wagering on the outcome of any match or of the tournament through TOGGL3, including through chat, polls, predictions or channel points. Channel points and other virtual items have no monetary value (Terms, Section 4.10) and may not be staked on a tournament outcome.

3. Your role

In short: You’re the MC. You don’t compete. You can’t register for, play in, or be a substitute in a tournament you host, on this account or any other. The same goes for anyone who helps you run it. Your job is to run the event and the broadcast fairly.

3.1 You never compete

You may not register for, play in, substitute in or otherwise compete in a tournament you host, whether on your own account, on any other account you control, or through someone playing on your behalf.

3.2 Nor does anyone who helps run it

The same applies to everyone who helps you run the tournament, including your channel moderators, co-hosts, casters and referees. TOGGL3 refuses registration from you and your channel moderators automatically; registration by any other account you or your helpers control is a breach of these Host Terms.

3.3 Consequences

If a host or helper competes, TOGGL3 may remove the entrant, void or correct affected results, cancel the tournament, remove your ability to host, and take action under Section 11 of the Terms.

4. Fair play

In short: You’ll publish your rules before registration opens and apply them the same way to everyone. You decide results and disputes. Every ruling is logged, and TOGGL3 can review or overturn a ruling, pause or cancel a tournament, or remove your ability to host.

4.1 Rules first

You must publish your rules before registration opens. A tournament cannot be published without them. Your rules must be clear, must be consistent with the Terms, these Host Terms and the Community Guidelines, and are fixed once the tournament is published. Where your rules conflict with the Terms, these Host Terms or the Community Guidelines, those documents control.

4.2 Consistent, good-faith decisions

You decide results and disputes under your published rules, in good faith, and apply the rules the same way to every player. You may not favor or disadvantage any player for reasons outside your rules, including their subscription, tips, gifts or relationship to you.

4.3 Rulings are logged

TOGGL3 records the results you enter, the rulings you make and the actions you take on the tournament, including pauses, cancellations, disqualifications and feed revocations.

4.4 TOGGL3 oversight

TOGGL3 may, at any time and without obligation, review or overturn a ruling or result, pause or cancel a tournament, remove or reinstate a player, revoke player feeds, and suspend or remove your ability to host. Disputes between you and players remain between you and them (Terms, Section 15.1), except where TOGGL3 chooses to act.

4.5 Unranked

Community tournaments are Unranked. Their results do not affect TOGGL3 ratings, XP, levels or any other TOGGL3 competitive standing, and you may not describe a community tournament as an official or ranked TOGGL3 event.

5. Subscriptions

In short: Channel Subscriptions can unlock watching your broadcast, never taking part. Subscribing can’t be required to register, and it can’t buy a better seed, a bye, a rematch or any other edge.

5.1 Who can watch

You may make your broadcast viewable only by your channel subscribers, or only by subscribers at or above a tier you choose, while the tournament is in progress. The recording of that broadcast carries the same audience. The bracket, entrants and results stay public in every case.

5.2 Never who can take part

A channel subscription, tip, gift or any other payment may never be a condition of registering, checking in or competing, and may never buy or influence seeding, a bye, a rematch, scheduling, a ruling or any other competitive advantage, whether on TOGGL3 or off it (Terms, Section 12).

6. Player feeds

In short: Player feeds are private, and they’re only for your broadcast. Each player’s feed is sent to you alone, with a temporary key that stops working when they’re eliminated or the event ends. You may show a feed in your broadcast. You may not record, clip, restream or share a raw feed anywhere else.

6.1 How feeds work

If you turn player feeds on, each player receives a temporary feed key at check-in, shown only to that player. A player’s feed goes only to your Control Room. You see the feed and its status, but never the player’s key. A feed key stops working when the player is eliminated, withdraws, is disqualified or rejected, or when you revoke it, and in every case when the tournament is completed or cancelled. TOGGL3 may limit how many feeds a tournament receives at once and the quality of each feed, and may disconnect a feed that exceeds those limits.

6.2 What you may do with a feed

You may watch a player feed in the Control Room and show it in your broadcast of that tournament on your channel. Players agree to this when they register, and TOGGL3 records their confirmation. If a player withdraws, stop showing their feed.

6.3 What you may not do

You may not record, capture, clip, restream, relay, rebroadcast or share a raw player feed, or give anyone else access to one, anywhere other than in your broadcast. This includes screen-recording the Control Room and sending a feed to another service.

6.4 What TOGGL3 does and does not keep

TOGGL3 does not publish or record raw player feeds. Your broadcast, including any feed you show in it, is recorded and retained like any other broadcast on your channel, under the same recording and retention rules, and is your User Content under Section 8 of the Terms.

6.5 The Control Room

The Control Room composes your broadcast in your browser and may use your camera and microphone if you allow it. The composed broadcast is published to your channel like any other stream, and you are responsible for everything in it. The credential the Control Room uses to publish is a broadcast credential under Section 7.7 of the Terms.

7. The game

In short: You have any permission the game’s publisher requires. Many publishers have their own rules or licences for community tournaments. Checking them and following them is your job.

7.1 Publisher permission

Before you publish a tournament you confirm that you have any permission or licence the game’s publisher requires for a community tournament and its broadcast, and you must follow the publisher’s rules, including any rules on prizes, branding and streaming. TOGGL3 does not verify this and is not affiliated with any publisher unless it says so.

7.2 No implied endorsement

You may not use a publisher’s or anyone else’s name, logo or trademarks in a way that suggests they, or TOGGL3, sponsor or endorse your tournament unless they do.

8. Conduct

In short: The Community Guidelines apply to your broadcast, your chat and every player feed. Everyone on TOGGL3 is 18 or older. Hosting and competing both need an active Player membership.

8.1 Guidelines everywhere

The Terms and the Community Guidelines apply to your tournament page, your rules, your broadcast, your chat and every player feed. You are responsible for moderating your channel during the tournament and must not show a feed that breaks the Community Guidelines.

8.2 Eligibility

Everyone on TOGGL3 must be 18 or older (Terms, Section 1.1). Hosting requires an active Player Membership, a claimed channel and creator eligibility, and competing requires an active Player Membership.

9. Reporting and enforcement

9.1 Reporting

Anyone can report a community tournament from its page, and a player, host, feed or broadcast through the reporting tools described in Section 10 of the Terms.

9.2 Enforcement

If you breach these Host Terms, TOGGL3 may take any action described in Section 4.4 and any enforcement action under Section 11 of the Terms. Your indemnity under Section 20 of the Terms includes claims arising from your tournament, any arrangement you make under Section 1, and any missing publisher permission.

9.3 Relationship to TOGGL3

You host as an independent creator (Terms, Section 7.2). You are not TOGGL3’s employee, agent or partner, you cannot bind TOGGL3, and TOGGL3 is not the organizer or sponsor of your tournament.

10. Changes to these terms

We may update these Host Terms as described in Section 22 of the Terms. Each version has a number. When a new version is issued you must accept it before you can continue to use the tournament hosting tools, and we record the version you accepted and when.
